These terms govern your use of kinetix.video and any music video produced by Kinetix (operated by Kyle Coghlan, San Diego, California). By submitting a project request or paying an invoice, you agree to these terms.
Kinetix produces cinematic music videos for independent artists from a song, a photo, and a short brief you provide. Videos are delivered as 720p MP4 files in one of four standard lengths (1:00, 2:00, 3:00, 3:30) at the published price for that length.
You start a project by submitting the form on kinetix.video. We reply within 24 hours to confirm we can take the project and send a Stripe invoice. Work begins after the invoice is paid in full. Prices are in U.S. dollars.
Standard turnaround is five business days from the date your invoice is paid. If a project requires longer for any reason, we will email you with an updated estimate before continuing.
One round of revisions is included with every project. Additional revisions, or revisions that meaningfully change the original brief, may incur additional charges that we will quote in advance.
Kinetix uses generative visual production tools to produce videos from your song and photo. By submitting a project, you understand and agree that the resulting video is created computationally rather than filmed on traditional camera equipment.
By submitting a song, photo, or other asset, you represent and warrant that:
You agree to indemnify Kinetix against any claim arising from a breach of these representations.
When the final video is delivered, you own the video. You may use it on YouTube, Spotify Canvas, Instagram, TikTok, Apple Music, in advertising, in sync deals, in press kits, and anywhere else.
You grant Kinetix a non-exclusive, royalty-free license to display the video and stills from the video on kinetix.video, in social posts, and in pitch decks for portfolio and promotional purposes. If you would like us not to display your video publicly, email us before delivery and we will mark the project as private.
You may cancel a project before work has begun for a full refund. Once production has started, refunds are governed by the Refund Policy.
The service is provided on an “as is” basis. While we make every effort to deliver high-quality work, Kinetix makes no warranty that any video will reach a specific audience size, generate a specific revenue, or pass any third-party filtering or moderation system on any platform.
To the maximum extent permitted by law, Kinetix’s total liability for any claim arising from your use of the service is limited to the amount you paid for the project that gave rise to the claim. Kinetix is not liable for indirect, incidental, special, consequential, or exemplary damages.
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in San Diego County, California.
We may update these terms from time to time. The “Last updated” date above will reflect any change. Continued use of the service after a change constitutes acceptance.
